1. Categories of personal data processed
A. If you are a customer of the website, MAXSTILE SRL will process your personal data, such as:
• first and last name;
• phone number;
• e-mail address;
• billing address;
• delivery address;
• data regarding how you use the website (e.g., your behavior/preferences/habits on maxstile.ro);
• as well as any other categories of data you provide directly when creating a user account, placing an order through the website, or otherwise arising from your use of the website.
If, to create a user account on the website, you use your Facebook or Google account, MAXSTILE SRL will process the following public profile data displayed by those applications: username, e-mail address.
If you choose to create a user account only before completing the purchase of a product available on the website, your e-mail address will be requested, based on which an account will be created automatically.
If you do not complete the order, the e-mail address and the other data provided will not be stored by MAXSTILE SRL, and the created account will be deleted automatically.
B. If you are a visitor to the website, MAXSTILE SRL will process your personal data that you provide:
• directly in the context of using the website, such as the data you provide in the contact/questions/complaints section, insofar as you contact us this way;
• indirectly, data such as: IP address, browser used, browsing duration, search history, operating system used, language and pages viewed, full URLs, clickstream sequence to, through and from our website, information or products viewed/searched, time spent on certain pages, information regarding interaction with pages (e.g., scrolling, clicks, mouse-overs), user behavior data.

2. Purposes and legal grounds for processing
A. If you are a customer of the website, MAXSTILE SRL processes your personal data as follows:
• to carry out the contractual relationship between you and MAXSTILE SRL, namely to take, validate, ship and invoice the order placed on the website, inform you about the order status, organize the return of ordered products, etc.
Legal basis: The processing of your data for this purpose is based on the contract concluded between you and MAXSTILE SRL, as defined in the Terms and Conditions at maxstile.ro/termeni-si-conditii. Providing your personal data is necessary for the performance of this contract. Refusal to provide the data may result in the impossibility of carrying out the contractual relationship between you and MAXSTILE SRL.
• to comply with the legal obligations incumbent on MAXSTILE SRL in the context of the services provided through the website, including obligations related to taxation and archiving.
Legal basis: The processing of your data for this purpose is necessary to comply with a legal obligation. Providing your data for this purpose is required. Refusal to provide the data may result in MAXSTILE SRL being unable to comply with its legal obligations and, therefore, unable to provide the services through the website.
• for marketing activities, namely to send, via distance communication means (e-mail, SMS), commercial communications regarding the products and services offered by MAXSTILE SRL through the website.

Legal basis: The processing of your data for this purpose is based on MAXSTILE SRL’s legitimate interest in continuously improving customers’ experience on the website. Providing your data for this purpose is voluntary. Refusal to provide data for this purpose will not have any negative consequences for you.
B. If you are a visitor to the website, MAXSTILE SRL processes your personal data as follows:
• for marketing activities, namely to send, via distance communication means (e-mail, SMS), commercial communications regarding the products and services offered by MAXSTILE SRL through the website.
Legal basis: The processing of your data for this purpose is based on your consent, if you choose to provide it.

Providing your data for this purpose is voluntary. Refusal to provide data for this purpose will not have any negative consequences for you.
3. Retention period
MAXSTILE SRL will process your personal data for as long as necessary to achieve the processing purposes mentioned above.
If you are a customer, we will process your data throughout the contractual relationship and thereafter in accordance with MAXSTILE SRL’s legal obligations (e.g., for financial-accounting supporting documents for which the legally required retention period is 10 years from the end of the financial year during which they were drawn up).
If you are a customer and exercise the option to delete your user account by pressing the “delete account” button in the “My account information” section, MAXSTILE SRL will interpret this action as your choice to unsubscribe from receiving commercial communications that keep you informed about products and services offered through the website.
Accordingly, if you choose to delete your user account, we will no longer send you such e-mails and/or SMS messages.
However, please note that deleting your account will not automatically result in the deletion of your personal data.
If you wish your personal data to no longer be processed or if you wish for your data to be deleted, you may exercise the rights detailed in section 6 below.
If you request deletion of your account but there is at least one active order on that account, the request for account deletion may be registered only after delivery of the products and completion of the last active order.
If you withdraw your consent for the processing of data for marketing purposes, the processing of your personal data for this purpose will cease, without affecting processing carried out on the basis of your consent prior to its withdrawal.

4. Disclosure of personal data
We do not rent/sell your personal data to third parties.
In addition to the controller, in certain situations, the data may be accessible to third parties such as service providers, carriers, hosting providers, IT companies, which may be appointed, where necessary, as processors acting on behalf of the controller.
They are contractually required to maintain the confidentiality of the data and to use it exclusively for the purpose for which it was provided.
We may also disclose your personal data to central/local public authorities in the following cases, listed by way of example:

Under the conditions provided by the legislation on personal data processing, as data subjects you benefit from the following rights:
• the right to be informed – the right to receive details regarding the processing activities carried out by MAXSTILE SRL, as described in this document;
• the right of access – the right to obtain confirmation from MAXSTILE SRL as to whether personal data concerning you is being processed, as well as details regarding the processing activities (how the data is processed, the purpose, recipients or categories of recipients, etc.);
• the right to rectification – the right to obtain the correction, without undue delay, by MAXSTILE SRL of inaccurate/unjustified personal data, as well as the completion of incomplete data;
• the right to erasure without undue delay (“the right to be forgotten”) – subject to certain conditions. Following a request for erasure, MAXSTILE SRL may anonymize the data (thus removing its personal nature) and continue processing it under these conditions for statistical purposes;
• the right to restriction of processing, under certain conditions;
• the right to data portability – the right to receive personal data in a structured, commonly used and machine-readable format, and the right for this data to be transmitted by MAXSTILE SRL to another data controller, to the extent the legal conditions are met;
• the right to object:
– in relation to processing activities, by submitting a request as indicated below;
– at any time, for reasons related to your particular situation, to the processing of personal data based on MAXSTILE SRL’s legitimate interest or on public interest grounds, except where MAXSTILE SRL demonstrates compelling legitimate grounds for the processing which override your interests, rights and freedoms, or where the purpose is the establishment, exercise or defense of legal claims;
– at any time, free of charge and without any justification, to the processing of personal data for direct marketing purposes;
• the right not to be subject to an automated individual decision – the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly affects you to a significant extent;
• the right to lodge a complaint with the National Supervisory Authority for Personal Data Processing or with the competent courts, where you consider it necessary.

7. Minors’ privacy
MAXSTILE SRL does not knowingly contact or collect information from persons under the age of 18. The website is not intended to request any type of information from persons under the age of 18.
If, by mistake, we come into possession of such information and we are notified of this, we will obtain appropriate parental consent to use such information or, if this is not possible, we will delete the information from our servers.
